A former Royal Marine Lance Corporal, has lost his case against the MOD following a Land Rover Crash in Afghanistan in 2006.
Tom Birch was 18 when he and a comrade were seriously injured after their vehicle plunged off a mountain track at OP Athens near Kajaki. In court he claimed that the MOD failed in their duty of care because the vehicle was defective and he was unclear about whether he was authorised to drive, given he didn't have a full UK licence.
The Judge, The Honourable Mr Justice Blair dismissed the claims.
